Alvin Que, the son of slain businessman Anson Que, remains a respondent in the kidnapping for ransom with homicide complaint pending a motion seeking to remove him, Prosecutor General Richard Fadullon said Thursday.
Fadullon said the panel of prosecutors has yet to act on the motion filed by the Philippine National Police (PNP) to remove Que as a respondent.
“Minabuti ng panel na imbis na aktuhan siya separately dahil may mga schedule ng preliminary investigation, sabay-sabay na nila ire-resolve ito kapag labas ng resolution,” Fadullon said in an ambush interview
(The panel decided that instead of acting on it separately due to the scheduled preliminary investigations, they will resolve everything at once when the resolution is released.)
“Ang sinasabi ng PNP sa kanilang motion na walang sapat na ebidensya na i-link o para isama si Alvin doon sa kaso. So sa tingin nila walang basehan para matuloy siya na ma-include pa rin,” he added.
(What the PNP is saying in their motion is that there is not enough evidence to link or include Alvin in the case. So in their view, there is no basis for him to continue being included.)
It was reported that Alvin Que
was among the six names
recommended for investigation by the PNP Anti-Kidnapping Group (AKG) to the DOJ on April 29.
Two days later, the PNP
cleared him
, stating that the AKG’s lawyers said there was no corroborating evidence that would link him to the kidnapping and eventual killing of his father.
Meanwhile, when asked if Que still needed to file his counter-affidavit, Fadullon answered “not necessarily.”
“It depends on… it depends, like I said, on what the evaluation of the prosecutor as of this time,” Fadullon said.
Que personally attended the preliminary investigation into the complaint for kidnapping for ransom with homicide at the Justice Department.
His camp said the complaint has been submitted for resolution, but they will wait for the panel of prosecutors to first resolve the PNP’s motion before filing a counter-affidavit.
“‘Yung motion na ‘yun iniintay namin na ma-resolve ng fiscal kasi kung halimbawang merong resolution in our favor. Hindi na kami mag fa-file ng counter-affidavit,” Atty. Pearlito Campanilla, Que’s lawyer, said.
(We’re waiting for the fiscal to resolve that motion because if a resolution is issued in our favor, we will no longer file a counter-affidavit.)
“Ngayon, kung halimbawa naman i-deny, humingi kami ng extension of time to file a counter affidavit,” he added.
(Now, if it gets denied, we have requested an extension of time to file a counter-affidavit.)
For their part, lawyer Freidrick Lu said his two clients, Yang Haohua and Yuan Fangquiang, have submitted their counter-affidavits.
Meanwhile, Justice Secretary Jesus Crispin Remulla has assured the family that the DOJ will be “very fair.”
“We try our best to just follow the rule of law. That’s what it’s all about,” he said in a separate ambush interview.
Anson Que and his driver were found stuffed inside nylon bags on a grassy portion of a road in Rodriguez, Rizal. They were last seen alive on March 29 when they left the businessman’s office in Valenzuela City.
The PNP previously said it is considering David Tan Liao, Kelly Tan Lim, and an unnamed suspect
as possible masterminds.
Meanwhile, a lawyer for Anson Que’s widow
wants Alvin Que to answer the allegations
against him through a counter-affidavit and pieces of evidence.
